DVT Misdiagnosis and Medical Malpractice

An increasing amount of medical malpractice claims stem from the misdiagnosis of DVT, also known as deep-vein thrombosis or deep venous thrombosis. DVT occurs when a blood clot has formed in a deep vein (as opposed to a superficial one, closer to the surface), often in the leg or pelvic veins.

Areas affected by DVT may be swollen, red, and have engorged small veins, but it may also occur without symptoms. The main concern regarding DVT is that the clot could travel to the lungs and cause a pulmonary embolism, which can be fatal.

Usual Procedure for DVT Diagnosis

Although specifics may vary depending on unique situations, there is a general sequence of events normally followed in the diagnosis of DVT, which includes the following:

1. During the patient’s first visit, the doctor should review the patients symptoms and medical history to determine whether DVT is possible and/or likely.

2. Based on those observations and conclusions, a doctor may order a special blood test and/or an ultrasound in which sound waves measure blood flow through the patient’s veins.

3. Venography, which tracks the flow of a special ink through the veins, may be used if other tests are are inconclusive.

4. Once DVT is diagnosed, a doctor will try to break down the clot, often through blood thinners.

Medical malpractice can occur at any of the above stages; for instance, if a doctor fails to recognize symptoms that would indicate DVT or misreads an ultrasound, the patient may have a case for medical malpractice.
Common Risk Factors for DVT

Those who suffer from DVT often have at least one of the following risk factors, although not always:

  • Birth control pills
  • Cancer
  • Genetic predisposition
  • Immobile for a long period of time (long flights, hospitalization)
  • Injury or trauma to the lower leg
  • Obesity
  • Pregnancy or recently had a baby
  • Smoking
